Below are the Official Rules about the the TLC®'s Mother's Day Sweepstakes
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.
A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN PUERTO RICO, U.S. TERRITORIES AND POSSESSIONS, AND WHERE PROHIBITED. OPEN ONLY TO U.S. RESIDENTS 18 YEARS OF AGE OR OLDER.
1. How to Enter: TLC®'s Mother's Day Sweepstakes ("Sweepstakes") begins at 12:01 a.m. (Pacific Time ["PT"]) on April 20, 2003 and ends at 11:59 p.m. (PT) on May 11, 2003 ("Sweepstakes Period"). Two ways to enter: 1) On-line Entry: Log on at www.discovery.com, click on TLC®, then click on the Sweepstakes banner, tile or link and follow directions to access the Sweepstakes entry form. Then, fill in the online entry form and submit it in accordance with the on-screen directions during the Sweepstakes Period, and you will be entered once. Limit of one (1) on-line entry per person per day; or 2) In-store Entry: Fill out an official entry form found at a participating Discovery Channel Store location (while supplies last) and deposit the completed entry form in the TLC®'s Mother's Day Sweepstakes in-store entry box. Limit of one in-store entry per day. On-line entries must be received by 11:59 p.m. (PT) on May 11, 2003. In-store entries must be received by the close of business of each participating Discovery Channel Store location on May 11, 2003. Neither Discovery Communications, Inc. nor The Procter & Gamble Company (collectively, the "Sponsor") nor RPMC, Inc. ("Sweepstakes Administrator") will verify receipt of entries. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.
2. Eligibility: To enter the Sweepstakes you must be a lawful permanent resident of the U.S. and be 18 years of age or older. Sweepstakes is void in Puerto Rico, U.S. territories and possessions and where restricted or prohibited by law. The Sweepstakes, and any web site pages and advertisements relating thereto, are intended for viewing only within the United States. You are not authorized to participate in the Sweepstakes if you are not located within the United States. Employees, officers and directors of Discovery Communications, Inc., The Procter & Gamble Company, Sweepstakes Administrator, their respective affiliated companies, parents, subsidiaries and advertising and promotion agencies (collectively, "Sweepstakes Entities"), and their immediate families (parents, children, siblings, spouse) and members of their households (whether related or not) are ineligible to participate in this Sweepstakes.
3. Drawing and Notification: Potential winners will be selected from among all eligible entries received in a random drawing held on or about May 20, 2003 by Sweepstakes Administrator, an independent judging organization, whose decisions are final and binding in all respects. Odds of winning a prize depend on the total number of eligible entries received. Potential winners will be notified by telephone, email or mail, at Sponsor's discretion. If a potential winner cannot be reached within ten (10) calendar days from the first notification attempt, then such person shall be disqualified and an alternate winner will be selected.
4. Prizes: One (1) Grand Prize: A trip for two (2) persons for a spa getaway to Sedona, Arizona. Trip consists of: Round-trip coach air transportation for two (2) from the major U.S. gateway nearest to Grand Prize winner's residence to Flagstaff, AZ; three (3) nights first-class resort accommodations at the Mii Amo Spa at the Enchantment Resort; breakfast, lunch and dinner daily; two 90-minute spa treatments (such as healing, ayurvedic treatments and facials); four 60-minute spa treatments (such as body treatments, mud baths and massages); healthy cooking and nutrition classes; unlimited fitness classes and season programs (such as qi gong, yoga and hula hooping); a Mii Amo robe, pool tote bag and water sports bottle; round-trip ground transportation between airport and resort; a year's supply of Olay Regenerist skincare product (in the form of 4 bottles of Regenerist) and an Olay T-shirt. (Approximate Retail Value ["ARV"] $10,485.00). Actual value will vary depending upon point of departure and any difference between actual costs and ARV will not be awarded. Grand Prize winner and his/her travel companion must travel together on the same itinerary. Grand Prize winner must arrange travel with Sponsor's agent at least 60 days in advance of trip. Travel subject to availability and blackout periods. Travel must be completed by June 15, 2004. If the potential winner is unable to travel by the deadline date then such potential winner will be disqualified and an alternate winner will be selected. All meals, insurance, tips, taxes and other expenses not specified are not included and are the sole responsibility of the Grand Prize winner. Fifty (50) First Prizes: An Olay prize pack, which consists of one bottle of an Olay Regenerist skincare product and a T-Shirt. (ARV $32.00 each). No transfer, substitution, upgrade, credit, refund or cash equivalent for prizes are allowed except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if a prize cannot be awarded as described for any reason. Limit of one (1) prize per person/family/household. All prizes will be awarded. Please allow 4-6 weeks for delivery of First Prizes. The total ARV of all prizes is $12,085.00.
5. Prize Conditions: Potential Grand Prize winner will be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release (except where prohibited) ("Affidavit/Release"). Travel companion of potential Grand Prize winner must sign a Liability and Publicity Release (except where prohibited) and must be 18 years of age or older. If either potential Grand Prize winner or his/her travel companion is deemed a minor in his/her state of residence, then the parent/legal guardian of such minor must also sign any documents required herein. All documents must be returned to the Sweepstakes Administrator by the date and/or time indicated within such documents. If a potential winner fails to return such documents within the specified time period, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner will be disqualified and an alternate winner will be selected. If a prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. All federal, state or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of each winner. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes winner's permission for the Sweepstakes Entities to use said winner's name, photograph, likeness, statements, biographical information, voice, and address (city and state only) on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.
6. Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Administrator, whose decisions are final in all respects, and to waive any right to claim ambiguity in the Sweepstakes or these Official Rules. By participating, entrants agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes.
7. Limitations of Liability: Sweepstakes Entities are not responsible for late, lost, damaged, misdirected, incomplete, illegible or undeliverable in-store entries, whether submitted by potential entrants or collected by personnel of a Discovery Channel Store location and/or lost, late, misdirected, undeliverable or incomplete on-line entries due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunctions. Sponsor may disqualify an entrant if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners by randomly drawing from those entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8. Entry Information: Please note that if you enter via in-store or check the "opt-in" box(es) on the entry form for this Sweepstakes, you are (i) agreeing that the Sponsor may share your entry information (including your name, address, email address, etc.) with its promotional partners and other parties; and (ii) granting Sponsor, its promotional partners and other third parties with which Sponsor chooses to share your information permission to contact you about its upcoming shows, promotions or for other reasons.
9. Rules/Winners List: To receive a winners list or an additional copy of these Official Rules, send a self-addressed, stamped envelope to: TLC®'s Mother's Day Sweepstakes, P.O. Box 8991, Calabasas, CA 91372-8991. Please specify "Rules" or "Winners List". Winners list requests must be received by June 30, 2003. You may also view the rules by visiting www.discovery.com and clicking on TLC during the Sweepstakes Period.
