Miss America: America’s Choice Vote

1. Voting Eligibility and Dates:

The “Miss America: America’s Choice Vote” promotion is open to all persons 13 and older located in the Continental United States (including Washington, DC), Hawaii, Alaska, Puerto Rico and the United States Virgin Islands and is void where prohibited. Voting will be open on www.tlc.com/missamerica beginning on Friday, January 4, 2008 at 11:00pm Eastern Standard Time and will end on Saturday, January 26, 2008 at 3:00am Eastern Standard Time (“Voting Period”). Voting times and dates are subject to change at TLC’s sole discretion without notice.

There is a one (1) vote per person per day limit during the Voting Period. A day period is defined as being from 00:00:00 Eastern Standard Time to 23:59:59 Eastern Standard Time.

Employees of Discovery Communications, LLC and TLC (the “Sponsors”) and Telescope, Inc. (the “Administrator”) and their respective parents, subsidiaries and affiliates are not eligible to vote.

By submitting any vote, voters agree to be bound by these Official Rules and that the decisions of the Sponsors, Administrator and judges are final and binding in all respects.

2. How to Vote:

To cast a vote, visit www.tlc.com/missamerica during the Voting Period and access the voting entry page. In order to participate, you must provide an e-mail address and zip code, confirm that you are 13 or older and cast a proper vote selection for your contestant of your choice. Once your vote has been cast, you will see a “Thanks for Voting” page. Sponsors and/or Administrator will then verify the vote. Once your vote has been verified, it will be counted toward that contestant. Once your vote has been cast you will not be able to retract it or change it. All votes become the property of Sponsor. There is no cost to vote except any charges you normally incur from your Internet provider for your Internet access. Such charges are not in the control of, nor the responsibility of, Sponsor or Administrator. We will endeavor to respond to enquiries within 24 hours, except when received during a weekendLimit: Twenty-two (22) votes per person (one (1) per day during the Voting Period. A day period is defined above in section 1). Entry information must be completed and verified in full in order for any vote to be counted. Proof of delivery or receipt will not be deemed by Sponsors or Administrators as proof of vote. Any attempted form of entry or vote other than as described herein is void.

3. Conditions for Voting:

Voters agree to be bound by these Official Rules.

4. Winning the Vote:

The Miss America contestant who receives the most eligible and verified votes during the Voting Period and who is not already included as a top 15 finalist in the Miss America Pageant, as chosen by the Miss America Pageant judges (“Top 15”), will be chosen to become the “16th finalist” in the Miss America Pageant. If the contestant with the top votes is already in the Top 15, the contestant with the next-highest number of votes will be the 16th finalist, and so forth. The 16th finalist will be announced at the Miss America Pageant airing on Saturday, January 26, 2008 at 8:00pm Eastern Time.

5. Disclaimers and Conditions:

Discovery Communications, LLC, TLC and/or Telescope, Inc., and the producers and administrators of the Miss America Pageant and program, their respective parents, subsidiaries and affiliated entities and any persons employed by any of the foregoing, are not responsible and shall not be liable for any losses/injuries or any kind resulting from lost, incomplete, late, damaged or misdirected votes; inability to access the voting; difficulties, failures or malfunctions of computers and/or Internet connections or wireless services or other communications malfunctions; interrupted or unavailable network, server; failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion or for any technical problem which may cause the voting to be disrupted or corrupted; computer on-line systems, telecast, or cable malfunctions; human error; satellite transmission failures or delayed telecasts or preemption of or the failure of a cable affiliate to televise the Miss America Pageant; any damage to entrants or any third person’s computer and/or its contents related to or resulting from this promotion; any votes that are not in compliance with these Official Rules (such votes to be deemed disqualified), nor any other loss directly or indirectly caused by participation in this promotion or related voting.

Any attempt to deliberately damage, destroy, tamper or vandalize the www.tlc.com/missamerica website or interfere with the voting is a violation of criminal and civil laws. Sponsors may, in their sole discretion, cancel, suspend or modify this promotion, the official rules, or any voting, at any time. In such case, the 16th finalist will be selected from the top number of votes received before termination, suspension, cancellation or modification of the promotion, or as otherwise determined by Sponsors in their sole discretion.

Sponsors reserve the absolute right to disqualify any voter (and/or their respective vote(s)) who votes by any electronic, mechanical or automated means, or otherwise tampers with the voting process or promotion, or for any other reason, as determined by Sponsors in their sole discretion.
