Voting:
- Voting Eligibility and Dates:
The “Miss America 2010” promotion is open to all persons 13 and older located in the Continental United States (including Washington, DC), Hawaii, Alaska, US Virgin Islands and Puerto Rico and is void where prohibited. Voting will be open beginning on Friday, January 29, 2010 at 10:58pm Eastern Standard Time and will end on Saturday, January 30, 2010 at 5:00am Eastern Standard Time (“Voting Period”). Voting times and dates are subject to change at TLC’s sole discretion without notice. There is a five (5) vote per person limit during the Voting Period per originating telephone number.
Employees of Discovery Communications, LLC and TLC (the “Sponsors”) and Telescope, Inc. (the “Administrator”) and their respective parents, subsidiaries and affiliates and members of the immediate families and persons living in the same household of such employees are not eligible to vote.
By submitting any vote, voters agree to be bound by these Official Rules and that the decisions of the Sponsors, Administrator and judges are final and binding in all respects.
- How to Vote:
Voting may be cast via text message. To cast a vote via text, send the state name of the contestant you want to vote for to 97979 during the Voting Period. In order to cast your vote you must:
- Have a valid telephone area code from the Continental United States (including Washington, DC), Hawaii, Alaska, US Virgin Islands and Puerto Rico
- Provide your own wireless device capable of 2-way messaging;
- Be a wireless service subscriber with text messaging service; and
- Use one of the following participating service providers/carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, Nextel, Boost, Alltel, U.S. Cellular, Virgin Mobile, Dobson, Cincinnati Bell, Cellular South, NTELOS, CellCom, Carolina West, Bluegrass Cellular, Cellular One, Centennial Communications, EKN, GCI Comms, Illinois Valley Cellular, Immix, Inland Cellular, Nex-Tech, Revol, United Wireless, West Central Wireless
Sponsors and/or the Administrator will then verify the vote. Once your vote has been verified, it will be counted toward that contestant. Once your vote has been cast you will not be able to retract it or change it. All votes become the property of Sponsor. Message and Data rates may apply when voting. Depending on your wireless plan, your wireless service provider may charge you for each text message you send and receive. Please consult your wireless service provider regarding their pricing plans as other charges may also apply. Message and data charges may appear on your cell phone bill or be deducted from your prepaid account

Entry information must be completed and verified in full in order for any vote to be counted. Proof of delivery or receipt will not be deemed by Sponsors or Administrator as proof of vote. Any attempted form of entry or vote other than as described herein is void.

If you no longer want to receive SMS communication from Miss America, text STOP, QUIT, CANCEL, END or UNSUBSCRIBE to 97979 at any time to opt-out of the promotion. Message and data rates may apply. - Conditions for Voting:

- Winning the Vote:
Up to four (4) Miss America contestants who receive the most eligible and verified votes during the Voting Period will be chosen to participate as finalists in the Miss America Pageant. The contestants will be announced at the Miss America Pageant airing on Saturday, January 30, 2010 at 8:00pm Eastern Time.
- Disclaimers and Conditions:
Discovery Communications, LLC, TLC and/or Telescope, Inc., and the producers and administrators of the Miss America Pageant and program, their respective parents, subsidiaries and affiliated entities and any persons employed by any of the foregoing, are not responsible and shall not be liable for any losses/injuries or any kind resulting from lost, incomplete, late, damaged or misdirected votes; inability to access the voting; difficulties, failures or malfunctions of computers and/or Internet connections or wireless services or other communications malfunctions; interrupted or unavailable network, server; failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion or for any technical problem which may cause the voting to be disrupted or corrupted; computer on-line systems, telecast, or cable malfunctions; human error; satellite transmission failures or delayed telecasts or preemption of or the failure of a cable affiliate to televise the Miss America Pageant; any damage to entrants or any third person’s computer and/or wireless device, and/or its contents related to or resulting from this promotion; any votes that are not in compliance with these Official Rules (such votes to be deemed disqualified), nor any other loss directly or indirectly caused by participation in this promotion or related voting.
Any attempt to deliberately damage, destroy, tamper or vandalize the www.tlc.com/missamerica website or interfere with the voting is a violation of criminal and civil laws. Sponsors may, in their sole discretion, cancel, suspend or modify this promotion, the official rules, or any voting, at any time. In such case, up to four (4) additional finalists will be selected from the eligible and verified votes received before termination, suspension, cancellation or modification of the promotion, or as otherwise determined by Sponsors in their sole discretion.
Sponsors reserve the absolute right to disqualify any voter (and/or their respective vote(s)) who votes by any electronic, mechanical or automated means, or otherwise tampers with the voting process or promotion, or for any other reason, as determined by Sponsors in their sole discretion.
